Child Support terminates upon a child’s graduation from High School or reaching the age of 19 years old, whichever occurs first. These factors constitute “emancipation”. If a child has emotional or physical disabilities, a court can order child support to be continue after a child has been emancipated. The Petition for Child Support must be filed with the court PRIOR to the emancipation event.  A disability is defined as a mental or physical impairment which substantially limits a major life activity. In January 2106, the law has been expanded to include disabilities a child may develop during his/her pursuit of a post-high school education.  However, these circumstances will be rare and will not “relate back” to the condition that existed in any form prior to the emancipation.
